Minutes of the Meeting held with PCC held on 12/01/2016 at Conference Hall, Secretariat, Silvassa
Dear all,
As informed you earlier, a meeting was held with Member Secretary, PCC, DD & DNH with industrial representatives in the Conference Hall, Secretariat, DNH, Silvassa on 12/01/2016 at 4.30 PM to discuss various issued related to non-renewal of consents and not obtaining valid consents. Your association SIMA is in receipt of Minutes of the Meeting and the scanned copy of Minutes of the Meeting is enclosed herewith.
Member Secretary, PCC informed that, there are numbers of industries in DD and DNH are running without a valid Consent from PCC. There are industries who have obtained Consent to Establish but not Consent to Operate thereafter and there are industries who have taken Consent to Operate but no Consent to Renewal thereafter. In the light of the order of National Green Tribunal dtd:08/05/2013 to run any industries without valid consent of PCC is a violation of Section 25 of Water (Prevention and Control of Pollution) Act, 1974 and Section 21 of Air (Prevention and Control of Pollution) Act 1981 and such industries are liable to face legal action by way of closure of such units. PCC has already made attempts to sensitize the industries about the statutory provisions of the law.
PCC has also informed that a list of industries who have not taken valid Consent to Operate/Consent to Renewal was placed on the website of PCC, DD & DNH.
So, all the industries of Dadra & Nagar Haveli are hereby requested to obtain the valid Consent to Operate and also get it renewed at the earliest otherwise PCC will be constrained to initiate legal action against such defaulting units.
It was represented by an industrial representative that, the industries of DNH are facing problems due to non-lifting of hazardous waste by the GEPIL under the pretext of non-payment of old arrears from the industries. Hon'ble Member Secretary, PCC informed that, leaving aside the commercial dispute between the industries and GEPIL necessary direction shall be issued to GEPIL to lift the hazardous waste from the authorised members to avoid any untoward incidents. On the suggestion of the industrial representatives, Member Secretary PCC has assured to take up the matter of charging 18% simple interest instead of 18% compound interest from defaulted units for the delay in obtaining Consent shall be discussed in PCC meeting.
So, all the industries are requested to go through the minutes of the meeting and obtain the valid Consent to Operate at the earliest to avoid any legal action from PCC.
