Notification issued by Department of Environment and Forest, DNH and DD.
Dear all,
Your association SIMA is forwarding herewith a Notification No. PCC/DMN/13(Part-VI)2020-21/448 dated 25.01.2021 issued by Joint Secretary, Department of Environment & Forest, UT Administration of Dadra & Nagar Haveli and Daman & Diu.
Vide the Notification, the department has partially modified the earlier notification issued with regard to the categorization of industrial sector/ projects under Red, Orange and Green categories. The revised list of industrial Sector/Projects are finalized and categorized under Red, Orange and Green categories at Annexure I to IV respectively shall be applicable in the UT of DNH & DD for the purpose of consent management and inventorisation of industries under Red, Orange and Green categories under Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 and sitting of industries only in conforming areas. There shall be no necessity of obtaining consent to operate to white category industries and only an intimation to that effect shall suffice and no Red category industry shall be allowed in the ecologically fragile areas / Eco-sensitive zone / Protected areas.
Whereas the CPCB has revised the categorisation of industrial sectors /projects under Red, Orange, Green and White Categories based upon the range of Pollution index through modified directions issued under section 18 (1) (b) of the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 vide letter No. B-29012/ESS (CPA)/2015-16/8571 dated 07.03.2016, letter No. B 29016/ROGW/IPC-VI/2020-21 dated 30.04.2020 and letter No B 29016/ROGW/IPC-VI/2020-21/2402 dated 10.07.2020.
Whereas CPCB vide above said modified directions, has directed all the state Pollution Control Boards/ Pollution Control Committees to adopt the revised criteria of categorisation of industrial sectors and revised list of Red Orange, Green and White categories of Industrial Sectors as mentioned in the final report attached with the above said directions and shall be used for consent management and inventorisation of industries under Red, Orange, Green and White categories and setting of industries shall be only in confirming areas.
The other conditions stipulated vide earlier notification shall applicable until further orders.
